Referral services and lead generators Marked D: the ABA Model Rule default applies until we check the state’s text. How we checked each rule

P Primary source
We read the rule, statute, court order, bar page or regulator page itself.
S Secondary source
A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
D ABA model default
The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
U Open question
Unknown or unsettled; a lawyer must answer it.

Arkansas has one rule that sets it apart: by our secondary source, any testimonial or endorsement makes an ad misleading. That bans the review quotes and client videos many injury firms rely on elsewhere. Add an Arkansas-licensed lawyer and office location in each ad, five years of records, and a Memphis metro that spans three states, and Arkansas campaigns need their own creative.

Not legal advice. Arkansas’s cells rest on secondary sources so far. The Arkansas Supreme Court’s rules control, and your counsel should confirm each point before you act on it.

Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean).

Defaults, recording and privacy

Payments to lead sources and ads in other languages are marked D. Until Arkansas’s text is checked, a firm pays for advertising, not for recommendations or a share of fees (ABA Model Rule 7.2), and Spanish ads carry their required statements in Spanish. Recording takes one party’s consent (S · guide); the trackers show no texting law with private suits (D · tracker); there’s no comprehensive privacy law (S · chart).

What this means for your SEO and ads in Arkansas

No testimonials, anywhere they act as ads

Star ratings, review carousels and “what our clients say” sections are testimonials. Keep them out of Arkansas ads and the landing pages those ads point to, and ask counsel whether the firm’s general site can show them. Google reviews on the firm’s Business Profile are a separate question, also for counsel.

Lawyer and office, pinned

The responsible lawyer must be licensed in Arkansas. In search ads, pin the lawyer’s name and the office city where Google keeps them, headline 1 or description 1.

Memphis, Fort Smith and Texarkana

Three of Arkansas’s six largest metros cross a state line. Memphis is centered in Tennessee, which sets a 30-day waiting period and regulates drug-lawsuit ads (Tennessee). Fort Smith reaches Oklahoma, with its Florida-style texting law (Oklahoma), and Texarkana reaches Texas, where most ads are filed within 10 days (Texas). Target by presence in Arkansas unless the firm is ready for both states’ rules.

Spanish in northwest Arkansas

The Fayetteville-Springdale-Rogers metro has the state’s highest Spanish share among its large metros, about 12%, roughly double Little Rock’s. About 47% of Arkansas’s Spanish speakers speak English less than “very well”, so Spanish intake should be in place before Spanish ads run.
