| Results, testimonials and “specialist” claims | Marked D: we haven’t checked this state’s own text on results, testimonials and specialist claims, so the ABA Model Rule default applies until we do. In practice: results only if truthful and given in context; “certified specialist” only through an approved body that the ad names. ABA Model Rule 7.2 and its comments | D ABA model default |
| Referral services and lead generators | Marked D: the ABA Model Rule default applies until we check the state’s text. Lawyers may pay reasonable advertising costs and a qualified referral service’s usual charges, never for a recommendation; lead generators are allowed only if they don’t recommend the lawyer, imply a recommendation or split fees. | Ads in Spanish and other languages | No state rule on ads in other languages found in the sources reviewed. Our default applies: every required statement appears in each language the ad uses. CAMG white paper: West Virginia lawyer advertising rules | D ABA model default |

| Texting and telemarketing law | No state texting or telemarketing law with private suits found in the 2026 trackers. How we checked each rule
- P Primary source
- We read the rule, statute, court order, bar page or regulator page itself.
- S Secondary source
- A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
- D ABA model default
- The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
- U Open question
- Unknown or unsettled; a lawyer must answer it.
West Virginia’s lawyer-ad rules are minimal by our secondary source, but its 2020 law on drug and device lawsuit ads is one of the most detailed of its kind: a set warning about medication, sponsor disclosures, and a misdemeanor for using health information to solicit without written authorization. Geography matters too. The Eastern Panhandle sits in the Washington, DC metro, and Huntington shares a metro with Kentucky and Ohio.
Not legal advice. The lawsuit-ad statute was read in its enrolled text; the rest rests on secondary sources and the ABA model. Confirm each point with counsel.
West Virginia rules in plain English
Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean).

Drug and device lawsuit ads
Lawsuit ads about drugs or devices carry a paid-advertisement statement, the sponsor and the firm or referral method, “Do not stop taking a prescribed medication without first consulting with your doctor.” and FDA-approval status. Defaults, recording, texting and privacy
Claims, referral payments and non-English ads are D: results stated with their facts, “certified specialist” only with a named body, vendors paid for advertising only (ABA Model Rule 7.2), and required statements in each ad’s language. One-party recording (S · guide); no texting law with private suits (D · tracker); no comprehensive privacy law (S · chart).

What this means for your SEO and ads in West Virginia
Lawsuit ads carry the statute’s words
We don’t run drug or device lawsuit campaigns. A firm that does needs every required statement in the ad and on the page, no use of health information without written authorization, and forms that collect none.
The Eastern Panhandle and Huntington
Jefferson and Berkeley counties sit in metros centered elsewhere: the Washington metro, mostly Virginia and Maryland (Virginia, Maryland), and Hagerstown-Martinsburg with Maryland. Huntington-Ashland reaches Kentucky and Ohio, and Winchester’s metro is centered in Virginia. Target by presence in West Virginia for in-state campaigns.
Charleston and Morgantown
Charleston and Morgantown are the largest metros wholly in West Virginia. Much of the state is rural, so the Business Profile, service areas and phone intake do most of the local search work.
Languages
West Virginia has the smallest share of residents who speak a language other than English at home, 2.8%. Spanish (1.4%) and Arabic (0.14%) are the most common.
