Mass-tort MDL tracker: federal docket counts
On October 1, 2026, 204,977 actions were pending in 162 federal multidistrict litigations (MDLs), and 93.7% of them were in product-liability dockets. One docket, Johnson & Johnson Talcum Powder Products (MDL-2738), holds 33.8%. The total is 55.9% below its November 2023 peak, mostly because the 3M earplug cases closed.

What is an MDL?
When many similar federal lawsuits are filed around the country, a panel of federal judges, the Judicial Panel on Multidistrict Litigation, can send them to one court to handle the shared steps. That group of cases is a multidistrict litigation, or MDL. The panel publishes a count of every MDL each month but keeps no history; we keep it.
What did we find?
- Most pending actions are product cases. 64 product-liability dockets hold 192,044 of the 204,977 pending actions (93.7%).
- The five largest dockets hold 64.3% of everything: Johnson & Johnson Talcum Powder Products (MDL-2738) 69,340, Davol, Inc./C.R. Bard, Inc., Polypropylene Hernia Mesh (MDL-2846) 23,324, Aqueous Film-Forming Foams (MDL-2873) 15,264, Hair Relaxer (MDL-3060) 12,381 and Proton-Pump Inhibitor (MDL-2789) 11,404.
- Fastest growth over 12 months, against the October 1, 2025 report: Depo-Provera (Depot Medroxyprogesterone Acetate) (MDL-3140) up 5,190 to 6,412, Uber Technologies, Inc., Passenger Sexual Assault (MDL-3084) up 2,195 to 4,916 and Bard Implanted Port Catheter (MDL-3081) up 2,167 to 4,140.

The court’s totals row for this report reads “Report Totals: 162 204,977 717,525”: dockets, pending actions and actions ever filed. Our rows add up to it exactly.
How did we build it?
We fetched each monthly report from jpml.uscourts.gov, waiting at least 10 seconds between requests as the court’s site asks. A script reads each table, and a report counts only if its rows add up exactly to the court’s own totals row. 82 reports from February 2019 to October 2026 passed. A new report is added every month the same way.
- Pending is not people. One action can stand for more than one person, and state-court cases aren’t counted.
- Gaps are left as gaps. Seven months had no report we could find, and five reports were unreadable or didn’t add up, so we left them out rather than guess.
- Product cases are flagged by title. A docket counts as product liability when the court’s title says so; a few mass torts are titled differently.
- Monthly snapshots only. Report dates vary by a few days, so “12-month change” compares reports about a year apart.
- Counts only. We name dockets by the court’s own title and number, and never a firm or a lawyer.
- Not legal advice, and not a list of cases anyone should join.

How many cases are pending in federal MDLs?
204,977 actions in 162 MDL dockets, according to the Judicial Panel on Multidistrict Litigation’s report of October 1, 2026. A year earlier, on October 1, 2025, it was 197,115.
What is the largest MDL right now?
MDL-2738, Johnson & Johnson Talcum Powder Products Marketing, Sales Practices and Products Liability Litigation, in the D. New Jersey, with 69,340 pending actions on October 1, 2026, or 33.8% of all pending MDL actions. Next are Davol, Inc./C.R. Bard, Inc., Polypropylene Hernia Mesh (23,324), Aqueous Film-Forming Foams (15,264), Hair Relaxer (12,381) and Proton-Pump Inhibitor (11,404).
Which MDLs are growing fastest?
Over the 12 months to October 1, 2026: Depo-Provera (Depot Medroxyprogesterone Acetate) (MDL-3140) grew by 5,190 pending actions to 6,412, Uber Technologies, Inc., Passenger Sexual Assault (MDL-3084) grew by 2,195 pending actions to 4,916 and Bard Implanted Port Catheter (MDL-3081) grew by 2,167 pending actions to 4,140.
What happened to the 3M earplug MDL?
MDL-2885 had 293,831 pending actions in August 2022, its highest in our data. By October 1, 2026 it had 2. Its decline is the main reason total pending MDL actions are 55.9% below their November 2023 peak of 464,724.
Does “pending actions” mean the number of injured people?
No. It counts federal court actions still open in the MDL. It falls when cases settle, are dismissed or go back to their home courts, and it leaves out state-court cases. Use it to compare one docket over time.
Where does this data come from?
From the Judicial Panel on Multidistrict Litigation’s monthly “Pending MDL Dockets by Actions Pending” reports, fetched from jpml.uscourts.gov. Every report’s rows add up exactly to the court’s own totals row; reports that don’t are left out. We add each new report every month.
