How we checked each rule

P Primary source
We read the rule, statute, court order, bar page or regulator page itself.
S Secondary source
A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
D ABA model default
The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
U Open question
Unknown or unsettled; a lawyer must answer it.

Kentucky is often listed as a filing state, but its review is voluntary: for $75, plus $100 for long ads, the Bar’s counsel gives an advisory opinion within 30 days. Ads name a lawyer and office address, or the firm, and “specialist” requires certification. A comprehensive privacy law took effect in 2026, and two of the state’s three largest metros, Cincinnati and Louisville, cross into other states.

Not legal advice. The voluntary review comes from the Kentucky Bar’s own page; the rest rests on secondary sources and defaults. Check with counsel before relying on any of it.

Kentucky rules in plain English

Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean).

A voluntary review, not a filing

$75, plus $100 for long ads, with an opinion within 30 days.

Verification: P · Kentucky Bar Association

Content, claims and timing

The name and office address of a lawyer, or the firm name. “Specialist” only if certified by an approved body. Targeted contact waits 30 days after a disaster.

Defaults

Referral payments and non-English ads are D: Kentucky firms may pay for advertising but not recommendations or a share of fees (ABA Model Rule 7.2), and a Spanish ad carries its statements in Spanish.

Recording, texting and privacy

One-party recording (S · guide); no texting law with private suits (D · tracker); the Kentucky Consumer Data Protection Act (2026) at 100,000 consumers, or 25,000 plus data-sale revenue (S · chart).

What this means for your SEO and ads in Kentucky

Use the review for ads that run all year

The advisory opinion is optional, but for evergreen TV, video and display ads it buys a Bar opinion before money is spent. Search ads change too often to submit each version; keep those within plain, factual copy.

“Specialist” is for the certified

Title tags, headings, Business Profile text and ads use “specialist” only with a certification from an approved body. “Focuses on” and “handles” work for everyone else.

Northern Kentucky and Louisville cross the river

Northern Kentucky sits in the Cincinnati metro, mostly Ohio, with part of Indiana (Ohio). Louisville’s metro reaches southern Indiana, which files targeted solicitations and sets a 30-day wait (Indiana). Clarksville is shared with Tennessee and Huntington-Ashland with West Virginia and Ohio. Lexington is the largest metro wholly in Kentucky.

Spanish and Swahili

Spanish speakers are 3.7% of Kentuckians, and 48.1% of them report limited English, one of the higher shares we track. Swahili and other Central, Eastern and Southern African languages (0.27%) have the highest limited-English share among Kentucky’s top languages, at 64.2%.
