How we checked each rule
- P Primary source
- We read the rule, statute, court order, bar page or regulator page itself.
- S Secondary source
- A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
- D ABA model default
- The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
- U Open question
- Unknown or unsettled; a lawyer must answer it.
Massachusetts keeps its lawyer-advertising rules close to the ABA model: no filing, a named lawyer or firm in each ad, and no waiting period that we’ve found. Two other facts shape a Massachusetts campaign more. Recording a call takes everyone’s consent, and the state has the highest share of Portuguese speakers in the country, with large Chinese and Haitian Creole communities beside its Spanish speakers.
Not legal advice. We summarize Massachusetts’s rules for marketing planning, from secondary sources so far. The Board of Bar Overseers and the courts apply them, and the rules change. Counsel’s sign-off comes before any ad does.
Massachusetts rules in plain English
Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean). Every Massachusetts rule here is S or D. We check each against the state’s own rule text before running a Massachusetts ad.

Results, testimonials and “specialist”
By our secondary source, Massachusetts tracks the ABA model here: a result needs its context, and a “certified specialist” claim needs a named, approved certifier.

Lead generators and referral services
Marked D, the ABA Model Rule default is our working rule in Massachusetts until we read its text: buy advertising, not recommendations, and use lead sources only if they neither recommend the firm nor share fees.
Ads in other languages
Massachusetts has no ad-language rule that we found; Portuguese and Spanish ads still carry every required statement in Portuguese or Spanish.

Call recording: all-party consent
Every party must consent to a recording (M.G.L. c. 272, §99).

Texting law and privacy
The 2026 trackers show no Massachusetts statute letting consumers sue over texts; the federal TCPA covers automated ones (D · tracker · 47 CFR 64.1200). It has no comprehensive consumer privacy law in force either (S · comparison chart).

What this means for your SEO and ads in Massachusetts
Calls come first
All-party recording matters most here, because call-tracking tools can record every call. Every tracked number we set up opens with a short recording notice before anyone speaks, and call grading stays inside the call-tracking tool. If your firm records intake calls today without a notice, fix that before any new campaign starts.
Ads and pages
- Name the responsible lawyer or firm in every ad. We add the office city too, our default in every state.
- Keep “specialist” for certified lawyers, and name the certifying body when you use it. “Focuses on” works everywhere else.
- Results need context. A settlement figure without the facts behind it is the kind of claim the ABA model treats as misleading.
The Boston and Providence metros cross state lines
- Boston reaches New Hampshire, also an all-party recording state, with its own privacy law in force since 2025 (New Hampshire).
- Providence is mostly in Rhode Island, where testimonials are labeled and paid or non-client endorsements disclosed (Rhode Island).
Target by presence and split campaigns by state when an area crosses the line.
Portuguese, Chinese, Haitian Creole and Spanish
Portuguese is next at 3.4%, the highest share of any state, and 46.8% of its speakers speak English less than “very well”; Chinese (2.2%) and Haitian Creole (1.3%) follow (Census, below). Spanish is far more common in the Springfield metro (17.4%) than on Cape Cod (2.4%).
- Google now decides which ads a search sees partly by language, matching the query’s to the ad’s, since September 2026 (Google). A Portuguese-speaking caller searching in Portuguese sees only Portuguese ads.
- Write Portuguese ads natively, for the community you serve, and staff intake to answer in Portuguese before the ads run.

Questions for your counsel
- Do the Massachusetts rules match the secondary source on naming, claims and the absence of a waiting period?
- How does the all-party recording statute apply to recorded intake calls and call grading?
How Probative works in Massachusetts
- We read the primary rules during onboarding. Massachusetts’s cells rest on secondary sources today, so the first step for a Massachusetts firm is checking each against the state’s own text, inside the normal setup.
- Recording notices on day one, on every tracked line.
- Your attorney approves every ad; there’s no filing to prepare.
Probative works with law firms in every state from day one, remotely and in person; travel terms are on the pricing page. Your attorney approves every ad before it runs, and where a state requires a filing, we prepare it and your attorney files it. Every Monday you see what each signed case cost, counted from your own records under The Probative Standard. The lawyer advertising rules by state table compares every state.
Questions firms ask
- Do Massachusetts lawyers have to file their ads?
- No filing, by the secondary source we use. An ad names a responsible lawyer or firm.
- Is Massachusetts a two-party consent state for recording calls?
- Yes. Massachusetts requires every party’s consent (M.G.L. c. 272, §99), by the 2026 guide we use. Every tracked line should open with a recording notice.
- Is there a waiting period before a Massachusetts lawyer contacts an accident victim?
- We found none in the source we use. Live solicitation of people who didn’t ask is off-limits under the ABA model rule, and we never do targeted outreach to injured people.
- Can a Massachusetts lawyer advertise as a certified specialist?
- Massachusetts follows the ABA model here, by our secondary source: “certified specialist” only through an approved certifying body that the ad names.
- What languages matter most for Massachusetts law firms after English?
- Spanish, at 9.9% of residents age 5 and older, then Portuguese, at 3.4%, the highest Portuguese share of any state, followed by Chinese and Haitian Creole (ACS).
