How we checked each rule
- P Primary source
- We read the rule, statute, court order, bar page or regulator page itself.
- S Secondary source
- A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
- D ABA model default
- The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
- U Open question
- Unknown or unsettled; a lawyer must answer it.
New Jersey’s lawyer-advertising rules are short, but two of them shape almost every campaign. When an ad uses a firm name, a New Jersey-licensed attorney is responsible for it, and comparisons and awards carry set wording, including the sentence “No aspect of this advertisement has been approved by the Supreme Court of New Jersey.” North and South Jersey also sit inside the New York and Philadelphia metros, so New Jersey ads routinely reach a second state.
Not legal advice. We summarize New Jersey’s rules for marketing planning, mostly from secondary sources so far. The courts and the ethics committees apply them, and the rules change. Use it to frame questions for counsel, not as answers.
New Jersey rules in plain English
Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean). Every New Jersey rule on this page is S or D: we haven’t yet read the state’s own rule text, and we do before running a New Jersey ad.
Filing and records
No filing for ads. Firms keep copies for 3 years and capture their websites.

Lead generators and referral services
Marked D: the ABA Model Rule default applies until we check New Jersey’s text. Lawyers may pay reasonable advertising costs, never for a recommendation, and lead generators may not recommend the lawyer or split fees. New Jersey’s Joint Opinion 741 (2021, read through a summary) warned that “leads” sold at per-person prices, such as mass-tort claimants, can be disguised referral fees.
Ads in other languages
No New Jersey language rule turned up. Our practice puts every required statement into the ad’s own language, whether Spanish, Portuguese or Gujarati.

What this means for your SEO and ads in New Jersey
Awards, badges and comparison words
- The award badge in your footer is an ad claim. On New Jersey pages, list an award as “included in” the named list, describe how the list is chosen, and add the Supreme Court sentence. A bare badge image doesn’t do that.
- Words like “best”, “top” and “leading” can count as comparisons, which carry the 85-character Supreme Court sentence. In a search ad, that sentence alone nearly fills a 90-character description, which is one more reason our default keeps comparison words out of ads.
- Name a responsible New Jersey attorney. For a firm whose ads run under the firm name, keep a New Jersey-licensed attorney named as responsible for each ad, in your approval records and wherever counsel wants it shown.
Two-state campaigns
New Jersey shares its biggest markets with its neighbors:
- North Jersey sits inside the New York metro. An ad aimed at the metro reaches New York, where ads carry “Attorney Advertising”, results carry “Prior results do not guarantee a similar outcome.” and the website is snapshotted every 90 days (New York).
- South Jersey sits inside the Philadelphia metro, along with Delaware and Maryland. Pennsylvania requires all-party consent to record calls and the office city in each ad, and it counts texts as live contact (Pennsylvania).
Set location targeting by presence, split campaigns by state, and check each one against that state’s rules.
Intake and privacy
- Recording notices on every line. New Jersey is one-party, but its callers often aren’t in New Jersey.
- No unsolicited sales calls to cell phones. Calls back to people who asked are a different thing, but keep the consent wording on your forms, naming the firm.
- Privacy thresholds count visitors. With a busy website and tracking tags, a firm can approach the privacy act’s consumer counts. Tags should wait for consent, and forms should ask only what intake needs.
Languages
New Jersey also has the highest shares of Hindi and Gujarati speakers of any state, and large Chinese and Portuguese communities (Census, below). Google retired language targeting on search in September 2026, so the words of the ad decide which searches it can answer (Google), so each language a firm wants to answer in needs its own ads.

Questions for your counsel
- Do the rule texts match the secondary source on firm-name responsibility, award and comparison wording, and records?
- Which words count as comparisons that need the Supreme Court sentence?
- Do any lead sources priced per person raise the concerns in Joint Opinion 741?
How Probative works in New Jersey
- Primary sources first. Because New Jersey’s cells rest on secondary sources, we check each one against the state’s own rule text during your onboarding, inside the normal setup.
- Your attorney approves every ad, and a New Jersey-licensed attorney is recorded as responsible for each.
- Split by state. New York-metro and Philadelphia-metro campaigns are checked against both states’ rules.
Probative works with law firms in every state from day one, remotely and in person; travel terms are on the pricing page. Your attorney approves every ad before it runs, and where a state requires a filing, we prepare it and your attorney files it. Every Monday you see what each signed case cost, counted from your own records under The Probative Standard. The lawyer advertising rules by state table compares every state.
Questions firms ask
- Do New Jersey lawyers have to file their ads?
- No filing for ads, by the secondary source we use. Firms keep copies for 3 years and capture their websites, so keep a dated record of every version.
- How can a New Jersey firm mention awards like a “best lawyers” list?
- Only as being “included in” a named list, with a description of the list’s methodology and the statement “No aspect of this advertisement has been approved by the Supreme Court of New Jersey.” A certification also names the certifying body. These points rest on a secondary source, so confirm the wording with counsel.
- What disclaimer does a New Jersey comparison need?
- An ad that compares the firm with others carries “No aspect of this advertisement has been approved by the Supreme Court of New Jersey.”
- Is New Jersey a one-party consent state for recording calls?
- Yes, by the 2026 guide we use. Many New Jersey campaigns also reach Pennsylvania, an all-party state, so tracked lines should open with a recording notice.
- Can a New Jersey firm buy leads?
- New Jersey hasn’t been checked beyond the ABA model on lead generators, but its Joint Opinion 741 (2021) warned that “leads” sold at per-person prices, such as mass-tort claimants, can be disguised referral fees.
- Does New Jersey have a privacy law that affects law firm websites?
- The New Jersey Data Privacy Act took effect in 2025. It covers controllers that process the data of 100,000 or more consumers, or 25,000 or more plus revenue from selling data, and website visitors count toward those numbers.
