| Results, testimonials and “specialist” claims | Marked D: we haven’t checked this state’s own text on results, testimonials and specialist claims, so the ABA Model Rule default applies until we do. In practice: results only if truthful and given in context; “certified specialist” only through an approved body that the ad names. ABA Model Rule 7.2 and its comments | D ABA model default |
| Referral services and lead generators | Marked D: the ABA Model Rule default applies until we check the state’s text. Lawyers may pay reasonable advertising costs and a qualified referral service’s usual charges, never for a recommendation; lead generators are allowed only if they don’t recommend the lawyer, imply a recommendation or split fees. ABA Model Rule 7.2 and its comments | D ABA model default |
| Ads in Spanish and other languages | No state rule on ads in other languages found in the sources reviewed. Our default applies: every required statement appears in each language the ad uses. CAMG white paper: North Dakota lawyer advertising rules | D ABA model default |
| Call-recording consent | One-party consent: a person on the call may record it. Recording laws by state, 2026 guide | S Secondary source |
| Texting and telemarketing law | No state texting or telemarketing law with private suits found in the 2026 trackers. The federal TCPA applies; state no-call lists and registration may still apply, but callbacks to people who asked to be contacted are generally outside them. State mini-TCPA tracker, July 2026 · 47 CFR 64.1200, the federal TCPA rules | D ABA model default |
| Privacy and health-data law | No comprehensive consumer privacy law in force. State privacy law comparison chart, updated October 8, 2026 | S Secondary source |
How we checked each rule
- P Primary source
- We read the rule, statute, court order, bar page or regulator page itself.
- S Secondary source
- A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
- D ABA model default
- The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
- U Open question
- Unknown or unsettled; a lawyer must answer it.
North Dakota has the smallest legal market in the country by employer law firms, 294 in the Census’s 2022 count. Its two largest metros, Fargo and Grand Forks, both cross the Red River into Minnesota. Its ad rules, by our secondary source, are minimal: no filing, a name and office address, and no waiting period found.
Not legal advice. For North Dakota, every rule below is either summarized by others or filled in from the ABA model. Counsel should confirm it before an ad runs.
North Dakota rules in plain English
Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean).
Filing, naming and waiting periods
No filing; name and office address in each ad; no waiting period found.
Verification: S · CAMG white paper: North Dakota
Defaults
Claims, referral payments and non-English ads are D: a result needs its facts, “certified specialist” needs a named certifier, a vendor may be paid for advertising but not for a recommendation (ABA Model Rule 7.2), and an ad in another language carries its required statements in it.
Recording, texting and privacy
One-party recording (S · guide); no texting law with private suits (D · tracker); no comprehensive privacy law (S · chart).

What this means for your SEO and ads in North Dakota
Fargo and Grand Forks are two-state markets
Moorhead and East Grand Forks are in Minnesota, which has a consumer privacy law in force since 2025 (Minnesota). Target by presence in North Dakota for North Dakota-only campaigns.
Small numbers need care
In a market this size, one firm may sign only a handful of cases a month from ads. We report every count, but we show a cost per signed case only when a cut has at least five, and we compare equal periods year over year to allow for seasons.
Bismarck and Minot
Bismarck and Minot are North Dakota’s other metros. Much of the state is rural, so the firm’s Business Profile, service areas and phone intake do most of the local search work.
Languages
Spanish speakers are 2.8% of residents. German (0.6%), Tagalog (0.36%) and Native North American languages (0.33%) follow; Tagalog speakers report limited English at 32.9%.
