| Results, testimonials and “specialist” claims | Marked D: we haven’t checked this state’s own text on results, testimonials and specialist claims, so the ABA Model Rule default applies until we do. In practice: results only if truthful and given in context; “certified specialist” only through an approved body that the ad names. ABA Model Rule 7.2 and its comments | D ABA model default |
| Referral services and lead generators | Marked D: the ABA Model Rule default applies until we check the state’s text. Lawyers may pay reasonable advertising costs and a qualified referral service’s usual charges, never for a recommendation; lead generators are allowed only if they don’t recommend the lawyer, imply a recommendation or split fees. ABA Model Rule 7.2 and its comments | D ABA model default |
| Ads in Spanish and other languages | No state rule on ads in other languages found in the sources reviewed. Our default applies: every required statement appears in each language the ad uses. CAMG white paper: Delaware lawyer advertising rules | D ABA model default |

| Texting and telemarketing law | No state texting or telemarketing law with private suits found in the 2026 trackers. The federal TCPA applies; state no-call lists and registration may still apply, but callbacks to people who asked to be contacted are generally outside them. How we checked each rule
- P Primary source
- We read the rule, statute, court order, bar page or regulator page itself.
- S Secondary source
- A summary or quotation of the rule by a legal-marketing firm, law firm or tracker. We check it against the official text before relying on it for a client.
- D ABA model default
- The state’s own text isn’t checked yet, so the ABA Model Rule or our national default applies until it is.
- U Open question
- Unknown or unsettled; a lawyer must answer it.
Delaware’s ad rules, as summarized by our secondary source, are among the shortest in the country: no filing, a name and office address in each ad, and no waiting period found. What makes a Delaware campaign tricky is geography. The state’s largest market, Wilmington, sits inside the Philadelphia metro with Pennsylvania, New Jersey and Maryland, and Delaware’s own privacy act starts at 35,000 consumers.
Not legal advice. Delaware’s cells rest on secondary sources and the ABA default. Plan with them, then confirm each point with counsel and the Delaware Supreme Court’s rules.
Delaware rules in plain English
Each rule shows its verification code: P for a primary source we read, S for a secondary summary, D for the ABA-model default (what the codes mean).
Filing, content and timing
No filing; name and office address in each ad; no waiting period found.
Verification: S · CAMG white paper: Delaware
The three defaults
Results and specialist claims, payments to lead sources and non-English ads are all marked D. In practice a Delaware firm states results with their facts, claims “certified specialist” only with a named certifier, pays vendors for advertising rather than recommendations, and puts required statements into each language its ads use (ABA Model Rule 7.2).
Recording
Treat recording as all-party (11 Del. C. §1335).

Texting and privacy
No Delaware texting statute with private suits appears in the trackers (D · tracker). The Delaware Personal Data Privacy Act (2025) covers controllers that process the data of 35,000 or more consumers, or 10,000 or more plus revenue from selling data (S · chart).

What this means for your SEO and ads in Delaware
One metro, four states
A Wilmington campaign aimed at the whole Philadelphia metro reaches Pennsylvania, where ads name the city of the office doing the work and texts count as live contact (Pennsylvania); New Jersey, with its set wording for comparisons and awards (New Jersey); and Maryland, with a texting law that allows suits (Maryland). Target Delaware campaigns by presence in Delaware, or check each ad against every state it reaches.
Notices and consent
Treat every recorded call as needing everyone’s consent: a notice at the start of each tracked line. The privacy act’s 35,000-consumer threshold counts website visitors, so tags wait for consent and intake forms stay short.
Languages
About 8% of Delawareans speak Spanish at home. Chinese, West African languages such as Yoruba and Twi, and Haitian Creole follow; Delaware has the second-highest share of West African language speakers of any state, after Maryland.
Dover and Sussex
Outside the Philadelphia metro, Dover is Delaware’s only other metro area. Firms serving Kent and Sussex counties depend on local search and the Business Profile more than on metro-wide campaigns.

Questions firms ask
- Do Delaware lawyers have to file their ads?
- No filing, by the secondary source we use. Each ad gives a name and office address.
- Is Delaware a two-party consent state for recording calls?
- Our source says to treat it as all-party (11 Del. C. §1335), so tracked lines should open with a recording notice.
- Does Delaware have a privacy law that can reach law firms?
- Yes. The Delaware Personal Data Privacy Act (2025) covers controllers that process the data of 35,000 or more consumers, or 10,000 or more plus revenue from selling data.
- Is there a Delaware waiting period before contacting accident victims?
- We found none. We never do targeted outreach to injured people anywhere.
