Estate planning ad rules in California

Older clients plan ahead, often with a grown child helping, and many first meet a firm at a seminar or through a mailing. Parts of California, including Modoc County and Sierra County, have no private law office at all. Below: California’s ad rules for an estate planning firm and the local figures behind them.

How would we work with an estate planning firm in California?

We would start with Google + SEO, because families research for weeks, so pages, reviews and the Google profile do most of the work: $8,750 a month with managed ad spend up to $15k (every price). The SEO part is priced by market size, and California’s largest metro areas by the Census count of residents aged 5 and over are Los Angeles-Long Beach-Anaheim, CA (about 12,308,275), San Francisco-Oakland-Fremont, CA (about 4,413,362) and Riverside-San Bernardino-Ontario, CA (about 4,392,015).

We would point the first pages, map listings and ad locations at San Francisco County and Orange County, which have the most one-lawyer practices per resident among the large counties, the firms most estate clients compare you with.

The closest case study: A legal-services launch cuts what each new client costs in half.

What are the key facts for estate planning ads in California?

  • Ad filing. No filing or pre-approval of ads is required.
  • What each ad must include. An ad must conspicuously show the name of at least one California-licensed lawyer, the law firm, the certified lawyer referral service or the joint advertiser responsible for it, and the city, town or county of at least one bona fide office or the address of record with the State Bar (B&P 6157.2(b)).
  • Texting and telemarketing. Automatic dialing-announcing devices may place calls only under a prior agreement in which the called person consents to receive such calls (Public Utilities Code § 2873).
  • Results and “specialist” claims. An ad may not contain a guarantee or warranty of success, a claim of immediate cash or quick settlement, an impersonation, an undisclosed dramatization, a spokesperson without a disclosed title, misleading statements about skills, experience or record, or an award that comes with membership or a fee (B&P 6157.2(a)).

Seminar invitations, mailings and “free consultation” offers are advertising, so the same filing and wording rules reach them.

What have California’s ethics opinions said?

  • San Diego County Bar Association, Legal Ethics Committee, opinion 2018-2 (2018), on calling prospective clients referred by a registered lawyer referral service: A lawyer may phone a person referred by a State Bar-registered lawyer referral service, because the person started the contact by asking the service for a lawyer. What to do: It is fine to call people a certified referral service sends you; do not cold-call people who have not asked for help.

Which Google, Local Services and Meta policies matter for estate planning ads?

California adds its own layer to the Google, Local Services and Meta estate planning rules: ad filing is listed as no filing, and what every ad must show is listed as name plus office address or city. The platform rules themselves are on the ads page and the policy tracker.

What else in California touches estate planning marketing?

  • Referral services and lead generators. A lawyer may not compensate, promise or give anything of value to a person to recommend or secure the lawyer's services, except to pay reasonable ad costs, the usual charges of a legal services plan or a qualified lawyer referral service (one run under the State Bar's minimum standards), a practice sale, non-exclusive reciprocal referral arrangements the client is told about, and a gift after a recommendation led to hiring if not promised in advance (Rule 7.2(b)). Employees, agents and vendors providing marketing services may be paid (7.2 comment [3]). A lawyer referral service must be State Bar certified (B&P 6155(a)(1)), and anyone may sue over an uncertified service for $5,000 to $100,000 per violation or three times actual damages (6156.5).

Where in California would an estate planning firm start?

Start with the metro pages: Bakersfield and Kern County law firm SEO and ads, Central Coast California law firm SEO and ads, Coachella Valley law firm SEO and ads, Fresno and Central Valley law firm SEO and ads. Spanish-speaking demand and the full California rules are on the California rules page.

What does the public data add for estate planning in California?

  • California’s superior courts together had 41,985 other probate cases (such as estates and trusts) filed in fiscal year 2024–25. The year before it was 42,873.

What do the local numbers say for an estate planning firm in California?

Counties with few or no law offices in California

4 of California’s 58 counties have fewer than 1 private law office per 10,000 residents, and 3 have none (first quarter of 2026); 0.5% of residents live in a county under that line. The most populous counties with no private law office are Modoc County (8,426 residents), Sierra County (3,098 residents) and Alpine County (1,043 residents).

What this means for an estate planning firm in California: In thin counties such as Modoc County, Sierra County and Alpine County, older clients there may not have a local firm at all, so phone and video signings with a clear price win the work.

What these figures leave out: counts offices, not lawyers or legal aid; counts offices, not lawyers; BLS withholds some county figures; employees only; partners and solo owners are not counted. Corrections log.

How would an estate planning firm plan its first quarter in California?

This work starts with trust. Older clients often bring a grown child, so build pages written for both, and plan a seminar or mailing only after your ad language is set. San Diego opens the quarter, where the metro page notes Spanish demand near the border, so a Spanish plain-language page helps. Central Coast follows, covering Santa Barbara, San Luis Obispo and Ventura counties, with Spanish demand in Santa Maria and Oxnard. Seminar invitations and free consultation offers count as advertising. On day one, a calm person answers and offers a visit.

In months two and three, count retained clients, meaning a signed engagement agreement or paid flat fee. Seminar RSVPs and booked consultations are early signals only. Compare San Diego with the Central Coast, and seminar guests with those who found you online. Cut mailings and events that fill rooms without producing signed clients. Call recording in California is listed as all-party, so tell callers at the start. Texting is listed as nothing beyond federal law, though older clients may prefer a phone call. Privacy is a comprehensive law in force, so protect the family details people share.

What does this mean for your estate planning firm in California?

  • Seminar invitations and mailings are advertising, so they follow the same California ad steps as a web ad. Ad filing: no filing.
  • San Francisco County and Orange County have the most one-lawyer practices per resident among the large counties, the firms most estate clients compare you with: start your pages and map listings there.
  • A retained client is counted when the engagement agreement is signed or the flat fee is paid; seminar RSVPs and booked consultations are early signals.
