Bankruptcy marketing has one federal advertising rule and one hard question: who actually signs? We build the SEO, ads and intake checks for bankruptcy firms, write the copy around the debt relief statement, and judge the work by retained clients (new clients who signed your fee agreement), counted in your own records. This is marketing information, not legal advice.

Who searches for bankruptcy help, and when?

Most people do not start with the word bankruptcy. They start with the pressure: a lawsuit from a card company, a wage garnishment notice, a letter about a foreclosure sale, a car about to be taken. Our job is to meet those searches with a calm page, an honest answer and a quick way to talk to a person.

  • Pressure searches. “Can they take my paycheck,” “what happens if I stop paying my credit cards,” “foreclosure sale date.”
  • Direct searches. “Bankruptcy lawyer near me,” “bankruptcy attorney flat fee.”
  • Cost searches. “How much does it cost to file.” Pages that explain how your fees work meet these.
  • Spanish searches, covered below.

Key facts

  • The Bankruptcy Code asks a firm to clearly and conspicuously disclose in any advertisement of bankruptcy assistance services that the services relate to bankruptcy relief (Bankruptcy Code, debt relief agency section).
  • The Supreme Court held that Attorneys who provide bankruptcy assistance to assisted persons are debt relief agencies under the BAPCPA (Milavetz).
  • Google’s Local Services list has a bankruptcy category, and its descriptions place foreclosure and repossession under it (Google).
  • A bankruptcy firm’s value per client comes from the firm’s own fee history, never from a national average.

What do bankruptcy ads have to say?

Short answer: the firm’s ads carry the set federal statement, or a substantially similar one, and your attorney approves the exact wording. Our guide on bankruptcy lawyer marketing covers the statement in depth. This page adds only the essentials.

  • The statement. The statute gives this wording: We are a debt relief agency. We help people file for bankruptcy relief under the Bankruptcy Code.
  • Where it applies. The statute reaches whether in general media, seminars or specific mailings, telephonic or electronic messages, or otherwise.
  • Ads that never say bankruptcy. The statute also lists ads about credit defaults, mortgage foreclosures, eviction proceedings, excessive debt, debt collection pressure, or inability to pay any consumer debt.
  • Who is covered. Attorneys are included, so a law firm cannot treat the statement as something for other companies.

Your counsel decides what each ad must carry. We build it into every template, and the attorney approves every ad before it runs.

Which channels work for bankruptcy firms?

Search is the main channel, because people search at the moment of pressure. The table shows what each channel is for and the care it needs.

Channel Role for a bankruptcy firm Care needed
Google search ads The main source of people who want a lawyer now Keywords and location only; junk searches blocked; see bankruptcy ads
Local Services ads Google has a bankruptcy category (Google) Badge, reviews and answer speed matter; see Local Services ads
Local and organic search Pages on each pressure situation, plus your Business Profile Calm, factual pages; see bankruptcy SEO
Meta and YouTube Awareness for people not yet searching Describe the service, never the viewer; no debt questions in forms
Microsoft search A smaller second search channel Show a real street address on landing pages
Referrals and reviews Past clients, other lawyers, local professionals Asked the same way every time

Intake decides the case

The ad rings the phone. Intake decides whether a frightened person becomes a retained client. In bankruptcy that moment is often urgent and often emotional, so we grade it carefully.

  • A person answers, fast. Missed calls from someone facing a deadline do not call back to you; they call the next firm.
  • Same-day consultations are offered whenever the schedule allows, because pressure fades the urge to wait.
  • The fee is explained early, in plain words, and a flat-fee quote is ready for the common situations.
  • Plain screening questions sort the matter without anyone giving legal advice on the phone.
  • A document checklist goes out the same hour, by text or email.
  • After-hours calls reach a person or a prompt callback the next morning.

The full process is in our guide on bankruptcy intake and consultations. To see how your own line performs, run the intake secret-shop worksheet, or let intake monitoring grade the calls.

What counts as a new bankruptcy client?

A retained client is someone who signed your engagement or flat-fee agreement, as your records show. If your firm counts a matter only when the first payment clears, we count it that way and label it. A booked consultation is an early signal and never the final count. Values come from your own fees, grouped in a few bands for the matters you take, so a simple matter and a longer matter are not treated alike. See what counts as a new client by practice and signed-case reporting.

How do the two common chapters change the marketing?

Two bankruptcy chapters bring most consumer clients. Chapter 7 of the Bankruptcy Code provides for liquidation, the sale of a debtor’s nonexempt property and the distribution of the proceeds to creditors. In Chapter 13, debtors propose a repayment plan to make installments to creditors over three to five years. And Individuals may use a Chapter 13 proceeding to save their home from foreclosure.

For marketing, this means two kinds of caller: someone ready to be done with the debt, and someone trying to keep a house or car. Your fees for each differ, so we track them as separate value bands, from your own fee history. We never say which chapter fits a caller. The attorney decides.

What about Spanish-speaking clients?

Many Spanish speakers search with their own words, such as “bancarrota” or “quiebra,” and want to talk to someone in Spanish. We build Spanish pages and ads written by native speakers, and we test that a Spanish call is answered by a person who speaks the language. See the Spanish hub, bancarrota, and our Spanish services.

What rules limit bankruptcy ads on the platforms?

  • Google treats negative financial status as a sensitive category: Google’s ad policy says advertiser-curated audiences cannot be used if promoting in sensitive interest categories (Google). We target bankruptcy ads by keyword and location.
  • Meta says ads cannot assert or imply that the viewer has a personal attribute, and its own examples include “Are you bankrupt?” (Meta). Copy describes the service.
  • Lead forms. Without Meta’s prior written permission, lead ad forms can’t ask about criminal or arrest history, bankruptcy or debt, health or disabilities, insurance details, or government ID numbers such as Social Security numbers.

State advertising rules also apply. See the lawyer advertising rules by state and the federal rules guide. Your counsel and your bar decide.

What this means for your firm

  • Put the debt relief statement in your ad and page templates now, and have your attorney confirm it.
  • Count signed fee agreements, not clicks or consultations, and review lost callers each week.
  • Answer pressure searches with calm pages and a fast, human first call.

Where you are now, and where you could be

Bankruptcy searchers start with the pressure, not the word. Find your row.

Where you are now What we do first What you can have by the first quarterly review
Ads and pages talk about debt relief without the set federal statement Put the statement on every ad and page, worded with your attorney Copy your attorney has approved, line by line
One page covers every kind of filing A calm page for each pressure search: a garnishment, a lawsuit, a foreclosure date, a repossession Pages that answer what the person typed, in plain words
Callers ask what it costs and find no answer A page that explains how your fees work Fewer cost-only calls and more booked consultations
Spanish speakers call, and the page is in English Spanish pages and a Spanish line at intake Spanish inquiries counted on their own line

What our own data show

Bankruptcy demand moves with the economy, and the court counts every filing. Our open data computes the national count and breaks it out by county:

621,111 bankruptcy cases were filed in the 12 months ending September 30, 2026, up 11.4% from 557,376 a year earlier.

From Probative’s open data, October 28, 2026. See the dataset · All the figures

See the county detail in bankruptcy filings by county, the complaints people file about debt and credit in consumer finance complaints by state, and how many law offices share each county in law-firm competition by county. The wording of the federal statement and the platform limits are above; the bar side of ads is in lawyer advertising rules by state.

What we never do for bankruptcy firms

  • Sell you leads, or charge per lead, per case or per share of fees.
  • Promise filings, discharges, a stopped foreclosure or any result.
  • Write copy that names the viewer’s money trouble or offers to “fix” credit.
  • Build audiences from client lists, or ask debt questions in lead forms.
  • Give legal advice, or tell a caller which chapter to file.
  • Contact anyone on your firm’s behalf.

How should bankruptcy firms explain their fees?

A fee that is clear before the first call screens out people who cannot go ahead and reassures the ones who can. Here is how firms in this practice usually charge, and what to say on your page.

How firms usually charge
Consumer bankruptcy lawyers usually charge a flat fee. In a liquidation case it is often paid before filing; in a repayment-plan case part of it can be paid through the plan.
What to say on your page
Publish the flat fee or a starting price, say what it covers, and keep it in line with the fee you disclose to the court.
Where the law shapes it
Federal law says the debtor’s attorney shall file with the court a statement of the compensation paid or agreed to be paid.

When a caller says it costs too much, the answer is a clear explanation, not a discount. See what to say, and what never to say, in our intake objection library.

Questions firms ask

Do our ads and website both need the debt relief statement?

The statute speaks of any advertisement of bankruptcy assistance services, and it names general media, mailings and electronic messages. We treat the website, search ads, social ads and email as covered, put the statement where a reader sees it, and your attorney confirms the final wording for your state.

Why do you count signed clients and not consultations?

A consultation shows interest, not revenue. Many bankruptcy callers book a consultation and never hire anyone. We show booked consultations as an early signal, then count only the people who signed your fee agreement, in your own records, so you see what the ads truly bought.

Can we run a lead form that asks about debt?

Not on Meta without its written permission. Meta says lead forms can't ask about bankruptcy or debt. We keep the form to name, phone, email and a general question, and ask the money questions on the call or on your own site, where your intake team can answer with care.

Will you promise a number of filings per month?

No. Nobody can honestly promise filings, calls or rankings. We build the pages, ads and intake checks, report what signed, and show where callers were lost. Demand moves with the economy, so we report it honestly each month, good or bad. Your attorney approves everything we publish.

Do you sell bankruptcy leads?

Never. Ads run in your own accounts, calls come to your phones, and you own the data. Our fee is a set monthly fee by ad-budget level, not a charge per lead, per case or per share of your fees.

What about people who are ashamed to call?

They are most of your market. Pages and ads describe your service in a calm, factual voice and never name the viewer's money trouble. Intake is trained to listen first, and a short online booking form gives people a quieter first step than a phone call.

Do bankruptcy ads need a special statement?

Yes. A federal statute asks a bankruptcy firm to include a set statement in its advertisements of bankruptcy assistance services, and the Supreme Court has held that attorneys are covered. Our guide on bankruptcy lawyer marketing covers the wording, and your attorney approves it for each ad.

How is bankruptcy marketing priced?

The fee is flat and set by the monthly ad spend we manage, never a share of your ad spend and never per lead or per case. The hero of this page shows where plans start, and the pricing page has every band.
